A WiFi Jammer at the packet layer?

If I read this correctly, the authors took a cheap dongle and used it to jam wifi signals at the packet layer, not the hardware (wireless) layer for a DOS attack.  I think this way you don’t run afowl of any laws about jamming…I think…
